The German version is legally binding. The following text is an automatic translation.
These General Terms and Conditions apply to all contracts for the purchase of digital photo downloads via the online shop at fbxl.eu/photos (hereinafter "Shop") between Eventfotodruck, Fabian Bödige (hereinafter "Provider") and the customer.
Eventfotodruck, Fabian Bödige, Bölkowstr. 2, 49565 Bramsche, Germany. Contact for shop enquiries: help@fbxl.eu.
The Provider grants access to digital image files (downloads) via a photo code. After payment is received, files are made available for download via an email link and on a confirmation page. There is no entitlement to physical delivery.
Images are not stored indefinitely. Files associated with a photo code are currently deleted after 13 months; if storage runs low, older codes without an active download window may be removed earlier. The download period after purchase is set out in section 6.
By selecting photos and submitting your order, you make a binding offer. The contract is concluded when the Provider accepts the order by enabling downloads after successful payment.
All prices are final prices in euros including statutory VAT. Payment is made via PayPal. The prices displayed in the shop at the time of ordering apply.
Downloads are available from receipt of payment for the period stated in the shop (currently 30 days) and may be downloaded as often as you wish during that period. Access expires automatically thereafter.
Upon conclusion of the purchase contract and full payment, the Provider grants the customer a simple, non-exclusive, unlimited licence in time and territory to use the purchased digital image files. The licence relates to the files purchased under the customer's respective personal photo code.
The customer may use the purchased image files for private and commercial purposes, including reproduction, distribution and public display (e.g. as prints, posters or other advertising media).
Any promotional reference or indication that the images originate from the Provider (fbXL or Eventfotodruck) or were created through its service requires the Provider's prior written consent.
Third-party rights, in particular personality rights of persons depicted, remain unaffected. The customer must obtain any required consents and comply with applicable law when using the images.
For digital content not supplied on a physical medium, the right of withdrawal expires if the Provider has begun performance after the customer has expressly agreed and confirmed knowledge that the right of withdrawal will expire (consent in the order process).
Statutory warranty rights apply. If you experience technical problems with downloads, please contact help@fbxl.eu promptly.
The Provider is liable without limitation for intent and gross negligence and for damage resulting from injury to life, body or health. Otherwise, the Provider is liable only for breach of essential contractual obligations, limited to foreseeable, typically occurring damage.
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. Place of jurisdiction for merchants is, where permitted, the Provider's registered office. If individual provisions are invalid, the validity of the remaining provisions is unaffected.
